1. Scope and Contracting Parties

These Terms and Conditions (T&C) apply to all relationships between DataFunnelInsights Inc. (hereinafter "DataFunnelInsights" or "we") and users (hereinafter "User" or "you") of the website datafunnelinsights.ink and the associated services.

By registering or using our services, you agree to these T&C. If you do not agree to these terms, you may not use our services.

2. Subject Matter and Services

DataFunnelInsights provides a comprehensive analytics platform for product analytics, marketing analytics, and business intelligence. The specific services depend on the plan you choose:

• Starter: Basic features for small businesses
• Professional: Advanced features for growing businesses and marketing teams
• Enterprise: Full features for large organizations

A detailed overview of features can be found on our pricing page. We reserve the right to expand, modify, or discontinue services, as long as this is reasonable for the user.

3. Registration and User Account

3.1 Registration

To use our services, you must register. You agree to:

• Provide truthful and complete information
• Keep your access credentials confidential
• Immediately inform us if you suspect that your account is being used without authorization
• Create only one user account per person

3.2 Minimum Age

You must be at least 18 years old to use our services. For minors, parental consent is required.

3.3 Account Suspension

We reserve the right to suspend or delete accounts if:

• You violate these T&C
• You have provided false information
• You use the services for illegal purposes
• You harass or harm other users

4. Usage Rights and Obligations

4.1 Permitted Use

You receive a non-exclusive, non-transferable right to use our services for your personal or business purposes, as permitted within the scope of your chosen plan.

4.2 Prohibited Use

The following is prohibited:

• Distributing malware, viruses, or other harmful code
• Copying, modifying, or reverse-engineering the services
• Using automated systems (bots, scrapers)
• Harassing, threatening, or harming other users
• Violating copyrights or other third-party rights

5. Payments, Cancellation, and Refunds

5.1 Prices and Payment

Prices for our services can be found on the pricing page. All prices are in US Dollars and exclude applicable taxes.

Payment is made by credit card, PayPal, or bank transfer. For monthly payments, the amount is charged monthly in advance. For annual payments, the total amount is charged once in advance.

5.2 Cancellation

You can cancel your subscription at any time with 30 days notice before the end of the month. Cancellation is done through the settings in your account or through our contact form.

We can cancel the subscription with 30 days notice before the end of the month, unless there is an important reason (e.g., violation of these T&C) that justifies immediate termination.

5.3 Refunds

Within 30 days of contract conclusion, you can exercise your right of withdrawal and receive a full refund of the amount already paid. After this period, no prorated refunds will be made upon cancellation.

6. Liability and Warranty

6.1 Availability

We strive for high availability of our services but cannot guarantee 100% availability. Planned maintenance work will be carried out outside business hours whenever possible.

6.2 Limitation of Liability

We are fully liable for intent and gross negligence. For slight negligence, we are only liable in case of violation of an essential contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place.

Liability for slight negligence is limited to the foreseeable, typically occurring damage at the time of contract conclusion.

6.3 Third-Party Content

We assume no responsibility for content provided by other users or third parties. We are not obligated to review such content.

7. Copyright and Intellectual Property

All content on our website (texts, images, logos, software, etc.) is protected by copyright and is the property of DataFunnelInsights or our licensors. You may not reproduce, distribute, or otherwise use this content without our prior written permission.

Content created by you (e.g., dashboards, reports) remains your intellectual property. However, by using our services, you grant us the right to store, process, and provide this content within the scope of the services.

8. Changes to the T&C

We reserve the right to change these T&C. Material changes will be communicated to you by email. If you do not agree to the changed T&C, you can cancel your subscription within 30 days after receiving the notification.

Changes take effect no earlier than 30 days after sending the notification, unless you agree to an earlier effective date.

9. Final Provisions

9.1 Applicable Law

Netherlands law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 Dispute Resolution

If you are a consumer, you can use the EU Online Dispute Resolution Platform at https://ec.europa.eu/consumers/odr. We are not willing and not obligated to participate in a dispute resolution procedure before a consumer arbitration board.
